Homma was guilty. Unlike Yamashita, Homma knew his troops, the one who committed the atrocities in China. Yamashita was put in charge of the entire army without even knowing the very troops who destroyed Manila. MacArthur feared for his reputation and could not bring it to himself to appeal Yamashita's verdict. Clearly, Yamashita at first tried to discourage brutality. At the end, he became powerless to stop it and was hung with western justice because he had "ridden with the outlaws."

Japan first attacked the Brits at Kota Bharu, Malaysia, 8 Dec 41, 90 min prior to Pearl. Roosevelt promised Churchill to side with Britain, if attacked. Having been defeated, MacArthur was a poor choice to head up the Japanese war crime trials. Only about 1/3 of the guards committed brutal acts & ~ half the prisoners road in trucks. Homma captured 1000s of tons of rice. Our forces were starved/emaciated before capture. Japan was starving & on rations 6 months into the war.
