If Scotland chooses to leave the Union, then it leaves that treaty behind. English people staying in Scotland are exempt from paying. A Scots student staying in England would have to pay!

The EU makes it illegal to charge for foreign students for education. England is part of the UK, but not Scotland, EU can't legislate for that!
