In the event that abortion becomes illegal and a woman obtains an abortion anyway, what should she be charged with and what should her punishment be? What about the doctor who performed the abortion?

Additional notes: Those who support making abortion illegal equate the procedure with murder. Are they ready to charge every woman who gets an abortion with murder? Are they ready to sentence her to the appropriate amount of time in prison?

  • Well the punishment would be varied as the situations dictated. Medical issues should be acceptable. Rapes/incest should be the mother's choice. Women who use abortion as a form of contraception should be held accountable. Some form of behavior modification and even sterilization if needed for those who are beyond social intervention. Thats just a generic conception that would need a lot of individual review. All the best

  • What is the difference between a fetus conceived by rape/incest and a fetus conceived by consensual sex?

  • I have a question of justice, what about the dead fetus, the nine month old in the partial birth abortion that gets an instrument stuck in the back of its head. What about the baby that survives an abortion and is left to die on a table?

Since when do pro abortion advocates care about justice? Justice according to Socrates' is the good owed to the other, where is the good for the baby. A baby's life shouldn't have to depend on sophists arguments for life. The baby is the one punished

  • That does not happen. Nice try, though.

  • I AM FOR ALL LIFE. That baby is important before it's born and after it's born. We can talk about the horror stories of abortions. But also we could talk about the born child not able to get affordable healthcare. YES I am FOR UNIVERSAL HEALTHCARE, and I don't care if a woman has to be on food stamps or welfare. IF this means it will be used to take care of that baby.

  • Imagine a famous violinist falls into a coma. The society of music lovers determines from medical records that you alone can save the violinist's life by being hooked up to him for nine months. The music lovers break into your home while you are asleep and hook the unconscious (and unknowing, hence innocent) violinist to you. You may want to unhook him, but the violinist is an innocent person with a right to life. Unhooking him will result in his death. Therefore, unhooking him is morally wrong.

  • @danboone143 I think your argument caves in on itself a little bit. If, according to the law, rights end where they infringe upon the basic rights of another person, doesn't this almost guarantee the right to an abortion? Isn't the baby infringing on the basic rights of the person who is carrying it? If a frame of reference helps, I'm thinking of terms of Judith Jarvis Thomson's "famous violinist" thought experiment, which I will post subsequently.

  • Any woman getting an abortion should incur massive legal penalties.

Such penalties will prevent many other women from getting abortions because they won't want to incur those penalties.

  • @paperserenade Right. You want to hold women accountable, but what about the men who had sex to make the woman pregnant? We get choice if we scream rape? Well guess what, the rape rate will suddenly go up in America.

  • I agree with Dan Boone, below.

I think you posed an intelligent question worth asking. You're smarter than most of the TV Talking Heads.

    And you're cute, too!

  • It's her body most certainly. However, the pre-born baby is not her body, it is a life in and of itself that is totally dependent on her to live.

We've allowed the pro-abortion rhetoric to obscure the facts. In law, the extent of your rights end where they infringe on the basic rights of another person.

I have the right to free speech but I don't have the right to lie in a court of law, commit perjury or slander etc.

  • Did you hear about the girl who was arrested for performing an abortion on her own baby while at prom? Why was performing an abortion on herrself illegal? It's her body, after all, isn't it? How was that different than paying a doctor to perform the abortion? Because the doctor wasn't paid.

  • The child inside the mother's body resides inside her body, yet it is *not* her body. It lives in her body for nine months, yes, but it is an individual with a body of its own. You cannot sweep life under the carpet out of convenience. If you're not ready to raise a child, don't have unprotected sex.

  • This childish girl wouldn't understand that. Her question seems to be based on a presumption that no one would think a mother or doctor aborting a child should be punished. She's wrong. Utterly disgusting human being.
