NC Helmet Law Propaganda Video

this video can be obtained from the police department which ticketed you. Once obtained, it can be used as evidence that NC LEO's are trained to check helmet compliance according to methods inconsistent with USC Title 49 Chapter 301 and the federal motor vehicle safety standards (FMVSS).
If you have a helmet ticket and are going to trial in Superior Court, you can subpoena the police department or the NC GHSP for a copy of the "Motorcycle Helmet Law Review" DVD, and any other training documents. Use them as defense exhibits.
KNOW YOUR RIGHTS
The motorcyclist in the video made critical mistakes during the stop. He should not have answered any question about the strap. He should not have taken off the helmet and handed it to the cop.
You do not have to talk with the cop and are better off exercising your right to remain silent.
Do not take off the helmet and hand it to a cop for inspection. Unless they have a warrant, or have articulable reason to suspect you have a weapon underneath the helmet, this is most likely an unlawful order. If they say they have authority to perform this search in order to gather evidence, where is their search warrant? Absent a warrant, the way to deal with this unlawful order is to remind the cop "I do not consent. Unless you have a warrant, that is an unlawful order and is an unlawful search of my person and property in violation of the 4th Amendment." If they repeat the order, they have the gun and taser, so comply under threat, but make sure it is an order and not just a request. These people are not your friend. They are treating you as criminal, want to violate you and your rights, and are definitely not your friend.
If the motorcyclist in this video knew better than to answer questions and remove the helmet, he could put on a decent defense at trial, regardless.

People dont drive thru a school zone where kids cross the street in an unsafe manner, driving within inches of a pedestrian. Why? Because you will get a ticket, or injure or kill a child. If people started going to jail for unsafe movements around motorcycles resulting in a catastrophic injury or death people would pay attention and be safe around bikes. DO YOUR JOB LEA.

If LEA enforced laws where cars and trucks were acting in an unsafe manner less bikers would be killed. A car will tailgate, cutoff, or pull in front of a motorcycle right in front of a cop and the cop will not do anything. You never hear about a motorcyclist pulling out in front of another biker (in a car or on a bike) why is that??? Bikers have better vision? No because bikers have situational awareness. LEA..DO YOUR JOB.
