What you are forgetting that when read our rights in the UK they are as follows:
"You do not have to say anything but it may harm your defence if you do not mention, when questioned, something that you later rely on in court."
Basically, it says if you DONT speak to the officer and you are charged, and then bring up a defence, it will not work. Because you didn't break your right of silence and tell the officer what happened.
