An El Monte police officer was caught on camera assaulting someone by kicking a criminal suspect in the head after he had already surrendered to police. Police initially attempted to pull Richard Rodriguez, 23, over after he had failed to yield. The routine traffic stop eventually turned violent after Rodriguezs car refused to stop, leading police on a 40-minute car chase through several Los Angeles-area highways, finally ending with a collision in Pico Rivera. Rodriguez got out of the Toyota Corolla he was presumably driving in and ran from police on foot. Rodriguez dropped, face-down, to the ground and put his hands above his head before the as-yet unidentified police officer ran up assaulted and kicked him on the side of the head.

Rodriguez was handcuffed, then taken to Greater El Monte Hospital for treatment. It is not clear whether or not Rodriguezs injuries were sustained during the earlier crash, or inflicted by the arresting officer. Video footage of the incident shows the police officer high-fiving another officer after Rodriguez was handcuffed. Lieutenant Chuck Carlson of the El Monte Police Department has said the departments internal affairs unit is currently investigating the incident.

Rodriguez is a recent parolee who had served time in state prison for drug charges and is suspected of being a gang member. Assault via police brutality is a much more common occurrence in the United States than most of us would like to admit. Police brutality is most often thought of as the excessive use of physical force, but can also include verbal attacks and psychological intimidation by a police officer. Knowing that police officer may have a tough time keeping a handle on their emotions (and adrenaline) during their work, laws have been enacted to curb those impulses as much as possible; impulses which often lead to assault. Procedural guidelines have been established as to how and when police may accomplish certain aspects of their work. If these guidelines and laws are not carefully followed, evidence they have compiled against you, even confessions to crimes, may be considered inadmissible against you in court.

  • It doesn't matter what crime this guy is suspected of doing. The fact is, a civilian can't do it to another civilian without being charged. So if a civilian can't do it, why should a cop be able to do it. Secondly, the suspect was obviously complying with the cops demands at this point. This is a total abuse of power and we don't need cops like this on the street. Period. This is flat out assault. It should be aggravated assault too since the officer already had compliance.

  • @tmmoore52 I'm sure people would have NO problem with extending that respect to officers of the law.....IF it were, in fact, returned. In reality we all know it isn't and it is usually the people who can least defend themselves that bear the brunt of these officers "humanity". There is NO quarter given by 90% of law enforcement that I have dealt with. However, I have seen them through the eyes of a virtually homeless person AND as a local business owner. Neither has resulted in very good exper.
