The officer testified in the police incident report to the following: "...I...OBSERVED A WHITE MALE WALKING...IN THE SECOND LANE...I STOPPED MY PATROL VEHICLE IN THE THIRD LANE OF RIVERS AVE EASTBOUND AND ASKED THE SUBJECT TO STEP OUT OF THE ROADWAY...THE SUBJECT...REFUSED THIS OFFICERS COMMAND TO LEAVE THE ROADWAY AND HAD TO BE ESCORTED FROM THE ROAD. WHILE ESCORTING...A STRONG ODOR OF ALCOHOL COULD BE SMELLED EMITTING FROM...PERSON..."
(There were four lanes, and the charges were Obstructing a Roadway and Public Intoxication. I was out of the road before the officer stopped his car, so what he said couldn't have happened. No attempt was made to have administered a field sobriety test and/or a test for B.A.C. The officer made up a story, and I went to jail.
