Peter Noone quit the band in 1970. In 1975, Barry Whitman and Derek Lekenby went to court in England and were awarded the rights to the name "Herman's Hermit's". So they legally own the rights to use the name.

Please note this is Hermans Hermits staring Barry Whitam, who was the original drummer for the Hermits. They tour mostly in Europe. Although Peter is not there, they clearly are better musicians then what Peter has in his group.
