An out-of-time hearing
To appeal a planning decision made by a local council in South Australia you need to lodge your appeal with the Environment, Resources and Development Court (ERD Court). The South Australian Development Act 1993 sets out time periods within which you must file your notice of appeal. If you miss the deadline, your case will be listed for an Out-of-time hearing where you will need to explain to the Judge why your appeal was late being lodged. This video (as at 15/6/09) shows what an out-of-time hearing looks like. It is a guide. It is not to be relied on as legal advice.
