These are the Acts which give the right of access to medical records.
The Data Protection Act 1998 - rights for living individuals to access their own records. The right can also be exercised by an authorised representative on the individual’s behalf.
• The Medical Reports Act 1988 - right for individuals to have access to reports, relating to themselves, provided by medical practitioners for employment or insurance purposes.

@colinberry1 Dear Mr. Berry. Since the Defendant (Costco) have accepted liability, it may no longer be necessary to see the HSE Report. What does your solicitor say the reason for delay is in this case? Did you know that Mrs. Berry has the legal right to see her medical reports, including of the incident? She just needs to write to the hospital and /or GP and ask to see them. These hospital assessments will form part of the evidence on which any claim for compensation will be based. Good Luck.

Dear Mr. Berry. I am so sorry that this apparently completely avoidable accident happened and that your wife was so badly injured as a result. I am also sorry about the idiots who have made such offensive and unthinking comments about a very traumatic experience for your good lady wife and yourself. I assume the Health and Safety Executive were involved after the incident.It would be a good idea to request a copy of the report, if your solicitor has not already done so.

No offense but a HUGE washing machine falling from high in the steel would have made noise, and she could have gotten out of the way.
(addendum) It is a sad fact that many Companies do not feel constrained to follow Health and Safety Law until they are forced to. However, the Duty of Care in law which Costco is required to uphold towards both employees and customers is not negotiable. There should have been a written risk assessment for the storage of the machines. If not, negligence is demonstrated. Hence, case in tort law. What is the delay with the action? Presume witness statements gathered? Best of luck.

Wingandaprayeruk, my kind sir its people like yourself that bring fresh air into our life, it helps to cushion the blows of our corrupted system here in the U.K. I will put forward your suggestion to our MP Andy Love. We have been through hell and still fighting for justice from our corrupted infrastructure that suppose to be there to protect us. I had to experience this for myself to believe it. Namaste

We were told by our Solicitors’ Royds, because Costco have accepted liability that under British law we was not entitle to see the health and safety report.

OMG!!!!! I can not believe wot i have just watched and listened too!!!!! Are you seriously trying to pull at the heart strings by playing cheese'y music and showing shots of your wifes asse? Fair enough big pay out day but you have just lost any bit of sympathy or compassion i had at the start! glad she is ok but i will tell you somethin i bet she had s*d all to do with that video ! you want taking outside putting against a wall and shooting you leech!!! using your missus to make money! disease!

craigdevlin1, the last thing that we want is sympathy; the accident took place on the 5.4.03 as you can see the video was submitted long after the accident. You mentioned money, just for the record the date today is October 1st 2008 and my wife has not received a single penny settlement.

Her accident has cost her all of her life savings and she had to close a life insurance policy at present she has to survive from loans from the family with interest rates accumulating and was told by her Solicitor that the defendant would not have to pay for her interest accumulating. I wonder how would you be handling this situation if it were on the other foot. I suggest before making such awful remarks please take the time to follow the treads posted.
