The girls are to be given over to the custody of social services authorities upon their return to North Carolina. Their stepfather, Matthew Hess, who absconded with Keara and Sierra on September 24, was extradited from Smith County, Tennessee, already facing single misdemeanor counts of child neglect and contributing to the delinquency of a minor. But it has been discovered that Matthew Hess faced more than two misdemeanor counts upon his return...

When Keara Hess and her sister first went missing, their mother, Janette, was not overly concerned because they were with their adopted father, Matthew Hess. However, Keara had missed an important doctor's appointment and the 12-year-old pregnant girl was nine months along, due to deliver within days, and Janette Hess soon began to worry when she did not hear from the missing trio. She filed missing persons reports and Tennessee issued an Amber Alert. A passing motorist would notice Matthew Hess' dark green Explorer and call 911 five days after he left the note saying he was getting supplies and dropping the girls off at school. Tennessee state troopers took Matthew Hess in for questioning and the girls to a hospital (as a precaution).

Iredell County, where Matthew and the girls lived, announced they would press misdemeanor charges against Hess and he was extradited back to North Carolina.
