The burden of proof is on the state for undocumtented workers, Simply being in the USA undocumented is not a crimminal offense.

You are right I mis-spoke, It is not a crimminal offense to be in the USA undocumented. Working in the USA undocumented can but 99%$ of the time does not carry a crimminal offense but To do so their would have to be a crimminal trial instead of a civil immigration hearing in front of a judge.
This is next to impossible and would require tons of resorces which they do not have.
In almost every case carries no crimminal offense to work in the USA.

ICE has the resources to pick up 59 maids, busboys and dishwashers, but it doesn't have the resources to pick up convicted criminals.
