DAY 3: CJ CORONA IMPEACHMENT TRIAL - SC CLERK OF COURT VIDAL BRINGS CORONA'S SALN JAN. 18, 2012

ARTICLE II
RESPONDENT COMMITTED CULPABLE VIOLATION OF THE CONSTITUTION AND/OR BETRAYED THE PUBLIC TRUST WHEN HE FAILED TO DISCLOSE TO THE PUBLIC HIS STATEMENT OF ASSETS, LIABILITIES, AND NET WORTH AS REQUIRED UNDER SEC. 17, ART. XI OF THE 1987 CONSTITUTION.

2.1. It is provided for in Art. XI, Section 17 of the 1987 Constitution that "a public officer or employee shall, upon assumption of office and as often thereafter as may be required by law, submit a declaration under oath of his assets, liabilities, and net worth. In the case of the President, the Vice-President, the Members of the Cabinet, and other constitutional offices, and officers of the armed forces with general or flag rank, the declaration shall be disclosed to the public in the manner provided by law. "

2.2. Respondent failed to disclose to the public his statement of assets, liabilities, and net worth as required by the Constitution.

2.3. It is also reported that some of the properties of Respondent are not included in his declaration of his assets, liabilities, and net worth, in violation of the anti-graft and corrupt practices act.

2.4. Respondent is likewise suspected and accused of having accumulated ill-gotten wealth, acquiring assets of high values and keeping bank accounts with huge deposits. It has been reported that Respondent has, among others, a 300-sq. meter apartment in a posh Mega World Property development at the Fort in Taguig. Has he reported this, as he is constitutionally-required under Art. XI, Sec. 17 of the Constitution in his Statement of Assets and Liabilities and Net Worth (SALN)? Is this acquisition sustained and duly supported by his income as a public official? Since his assumption as Associate and subsequently, Chief Justice, has he complied with this duty of public disclosure?

SC clerk of court brings Corona SALN

THE trial proper on the impeachment of Chief Justice Renato Corona finally started yesterday, with the prosecution presenting its first witness.

However, Supreme Court clerk of court Enriqueta Vidal reluctantly turned over to the impeachment court Corona's statement of assets of liabilities and net worth (SALN) of Corona from 2002 to 2010.

Vidal is a witness for Article II of the eight articles of impeachment. As clerk of court, her office receives SALNs, and subscriptions and signatures are done before her.

Article II accuses Corona of committing culpable violation of the Constitution and betrayal of public trust when he failed to disclose to the public his SALN as required under Section 17, Article XI of the Constitution.

Vidal said she did not have authorization from the tribunal to release Corona's SALN but finally relented, on the order of Senate President Juan Ponce Enrile.

"The chair has ruled that we now require the witness to surrender to us the pertinent SALN that she brought to this court," said Enrile.

Based on the documents submitted by Vidal, Corona's SALN in 2010 was P22.9 million.

In 2002, his SALN was P14.96 million. It went down to P7 million the following year and slightly increased (P7.35 million) in 2004. It steadily went up in the succeeding years -- P8.35 million in 2005, P9.559 million in 2006, P11.05 million in 2007, P12.5 million in 2008, and P14.5 million in 2009.

Vidal said she is restricted by a resolution of the high court, which was issued during the administration of Corazon Aquino, requiring the clerk of court to get clearance from the court en banc before releasing the SALN to the public.

"In view of resolution of court on May 2, 1989, I am restricted because it says here in one of the guidelines that all requests for statements of assets, liabilities and net worth will have to be filed with the clerk of court. It means it will only be filed with me," Vidal said.

"It is not within my competence, it is within the competence of the court," she added.

Corona's lawyers, after Vidal turned over the SALNs, said the chief justice had authorized the release of his SALN.

Tranquil Salvador III, also a spokesman of Corona's camp, said in a press briefing during a break that they had long been given the go-signal to release Corona's SALN, to refute allegations of the House prosecutors that the chief justice amassed unexplained wealth exceeding his means and failed to report it in his SALN.

Salvador said it would be useless not to release the SALN as this could be the best evidence that the defense has to prove Corona's innocence in the charge under Article II.
