In this excerpt, I lead a hostile witness testify that the trash receptacles are full of sludgy and nasty garbage. Furthermore, I lead her to testify that the cleaning staff had specific instructions to clean in a "general circuit," which did not include for cleaning the stairwell or throwing out the garbage. Moreover, I her to testify that it could take at least 20 minutes before the cleaning staff got back to the area of the restaurant near the stairwell.

Later in my cross, despite the fact that she had reason to know that the handrails would be covered in grease and animal fat, I lead her to testify to she did not instruct her employees to clean the handrails and stairwells.

I was representing a fast food franchise patron who slipped and fell down a flight of stairs. It was her claims that there was something foreign on the second step that caused her to lose her footing. To make matters worse, she tried to stabilize herself, by grabbing the handrail, but it was too slippery. Our investigation determined that the something dripped out of the garbage, which was located at the top of the stairs.
