TNGA House committee hearing on the last legislative bill introduced in 2010 by former Rep. Jason Mumpower - ironically, Mumpower (who is neither a certified public accountant or licensed attorney) was appointed to a newly created "Executive Assistant to the Comptroller" position paying $146,800 per year that was not created by enactment of a law by the Tennessee General Assembly.

Mumpower is now the second highest paid state employee within the Tennessee Comptroller office.

The Tennessee General Assembly had enacted legislation within the previous year to raise the costs of providing state audits to local governments, and as I recall, raising an additional $225,000 dollars for the Comptroller's Office.

Fiscal Summary - Increase State Expenditures - $70,000

Bill Summary
This bill creates the position of small business advocate within the office of the comptroller of the treasury to answer questions and provide information to residents of this state who are starting a small business or who already own a small business. This bill authorizes the small business advocate to informally mediate and assist with the resolution of issues concerning small business owners and state departments and agencies. The comptroller will be required to choose the small business advocate from existing personnel within the comptroller's office.

This bill requires that each department and agency in state government that has any regulatory authority over business activity must appoint a person from existing executive service personnel to serve as a contact person for the small business advocate when the advocate has an issue or question concerning the department or agency.

This bill requires the small business advocate to do the following:

(1) Work with each state agency and department with regulatory authority over businesses to ensure that small business owners who receive or are subject to enforcement-related communication or contact by agency or department personnel are provided with a means to communicate on the enforcement activity conducted by such personnel;
(2) Establish means to receive comments from small business owners regarding actions by agency or department employees conducting compliance or enforcement activities;
(3) Establish means to refer comments from small business owners to the appropriate contact person of the affected agency or department; and
(4) Rate agencies on the extent to which they notify small business owners about the existence of the small business advocate.

This bill requires that the small business advocate report annually to the senate commerce, labor and agriculture committee and the commerce committee of the house of representatives regarding evaluating the enforcement activities of department and agency personnel, including a rating of the responsiveness to small business owners' concerns. This bill also requires that the small business advocate prepare an annual report on the advocate's activities, findings and recommendations to the governor, members of the general assembly and to the heads of affected state departments and agencies.

ON APRIL 29, 2010, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 3484, AS AMENDED.

AMENDMENT #1 requires the comptroller to implement this bill without using additional resources.
