People with Munchhausens via proxy can still be charged with crimes, provided that they're non-delusional (and not all of them are; many know exactly what they're doing). I've read about several different cases where an individual with the illness was charged and convicted for what they did to their child.

@nlrooker02 i like how people do see the severity in a mental illness. understand a person with metal illness doesnt not have control over there actions and sometimes doesnt even relise there doing something when they are. she didnt know she was poisening her son. please people try to take mental illness as physical illness dont jsut through out like some escuse people use. because thats not the case.

Well it may not be illegal for a person to have a psychiatric illness, but illness or not, as a parent that mother is responsible for her actions. A psychiatric illness absolutely does not excuse the fact that she willingly jeapordized her son's health and could very easily have killed him. Having an illness is not illegal, but putting your child's health and life in danger most certainly is.
