Hiroshima and Nagasaki were both military-industrial targets. It's quite impossible to hit military targets without civilians killed. Every firebombings in WW2 had civilians hit and killed. The nukings aren't any different. In Total War, civilians played part of the war, working in industrial war factories, therefore, they were removed from being immune to air attacks. Sherman in US Civil War said that you not only wage the war on the army but strike the heart of civilians supporting it.

I'm not justifying bombing civilians, I am just being realistic. Hiroshima and Nagasaki had military targets and it is quite impossible to get them without civilians getting in the way. Practically every bombing in WWII had civilians getting hit. Should everybody have been subject to war crimes? And exactly WHO should have been the one's sitting in judgement? It is a very idealogical point of view. If your opponent is waging total war you have to as well. Sherman was right.
