3rd unit had differant markings on it looked like LMS?

Yep. You can see it in freeze-frame; the number looks like 733.

how come some of the conrail units dont have patches on them?

Not sure, but the CR fans among us would say it was luck. :) The SD70 however, did not need to be patched since CR specified they be built to NS specs and numbered into the same series as NS's SD70s when they were ordered.
