How to Neutralize Police Checkpoints

On Saturday, September 4th, 2010 Keene New Hampshire liberty activists respond to a state and local police "sobriety" checkpoint where police check drivers license, registration, tags, and do a plain sight search of the vehicle to ensure the driver is sober.

In NH the checkpoints are filed with a petition at their Superior court that names the date, time, and place of the checkpoint. We held signs at the traffic circle 100 yards away informing people of the checkpoint.

There is a thing called Presumption of Innocence in American Jurisprudence, which road blocks violate. The road block is a presumption of guilt. Another problem with DUI laws that the "authorities" tap dance around is Habeas Corpus - if there is no injured party then there is no crime. You have a right to face the party that you harmed in a court of law. If you have harmed none, then how can you be held guilty?

Nope. These checkpoints have been found to be consistent with the 4th amendment via Michigan Department of Police. It was determined because the public interest in stopping drunk drivers is outweighs the initial stop itself. Remember that the constitution is a 200 year old document that so far has not aged well. It has been repeatedly amended and reinterpreted. It needs to evolve with our needs.
