You're 100% correct. Territory won by war is illegal. Which makes territory taken by Jordan in 1948 completely illegal. Israel's liberation of the territory assigned as a homeland to the Jewish People under article 22 of the League of Nations Covenant was however perfectly legal. The McMahon Hussein secret treaty did not include Palestine. This was corroborated by McMahon in 1922 and again in 1937. In any case, you can't promise what you don't own, and in 1916 it was Ottoman land, not British.
