  • It really muddies the waters doesn't it? I say if you are willing and able to follow to the instructions of the Court, I believe you still have the right to change your mind if you detect cause...just like the "judge" took an oath of office. It is this entrapment of those empaneled on the jury that has allowed the current mockery of what used to be our justice system.

  • But yeah, you're right. The jury isn't obliged to follow the judge's instructions. Jury nullification is a controversial right, but it's got a long history all the way back to English Common Law.

  • @wachobf You're right, but there's a flip side to that coin. If counsel asks you during voir dire if you're willing and able to follow the instructions of the court as pertains to the law, and you say no, you would be dismissed from jury service for cause. So you'd never sit on the jury anyway.

    And if you were asked that same question and you said yes, but yes wasn't the truth, and the court found out about it, in certain (albeit rare) cases you could be found guilty of contempt.

  • Correction, it is around 12:45. Only if those instructions do not lead the jury to believe that they do not have the right to judge the LAW and the FACTS.

  • Around 13:03, perhaps the judge needs to be educated as to what "All political power is inherent in the People" means. The jury has the RIGHT to judge both the LAW and the evidence. To come against that right is to WAR against the Constitution and meets the definition of an Act of Treason.

  • I plan to practice criminal law in the State of California. I may do some civil cases if an indigent person has been abused by the police of by another government entity but for the most part I plan on being a criminal defense attorney.
