The pony swim takes place on the Virginia side and the Chincoteague fire company owns the herd. Horses may be purchased from the fire company at the pony swim. The Maryland herd is a free roaming band of feral horses who are allowed to live wild and free at Assateague Island National Seashore. They are never sold and visitors are reminded that feeding or petting the horses is against park regulations - these are wild horses who are unpredictable and may kick and bite.

I've never been there, but they have a "pony swim" each year in which they swim all the ponies to nearby Chincoteague and auction some off... this both keeps the ponies from overpopulating and helps fund Chincoteague's fire department... I am pretty sure that's the only way you can get one.
