Thomas L Jenkins, A Black American in the 1960's was working for the Employer, United Gas Corporation, as a "Serviceman's Helper" at the time this action was commenced. In May 1965 Mr. Jenkins (United Gas Employee) applied for promotion to the position of "Serviceman." When an opening occurred in August 1965 it was to a unqualified White Employee who was not qualified according to Employer's (United Gas) job specifications. Thomas Jenkins (Employee) filed a Racial Discrimination charge with EEOC on November 4, 1965, saying he was refused the promotion because of his race. The investigation by EEOC substantiated the charge and the 1st EEOC case was tried November 4th, 1965 and WON! Thomas L Jenkins was immediately promoted to Serviceman and was the 1st to experience same wages as white because of a court appointed judgement..
