BLYTHE, Calif -- There is a pending lawsuit against the school district, and no one has been more surprised to find this out then the Board members themselves, other than the possible exception of Robin Wellman. The Board didn't know that the Board itself was in danger of getting sued for the past four months.
This seems to be an ongoing problem with the Palo Verde Unified School District (PVUSD) Board. It is the last to find out about even those issues directly impacting the Board itself. Now again, the Board has become aware of another major issue through outside sources, and apparently not through proper disclosure by the Superintendent or other internal channels of information.
Here's what's happening. There was a Tort Claim filed against the District back in September 2010. The PVUSD Board of Education is only now learning about this Tort Claim four months after its filing against the District.
Here are the facts regarding the filing of Tort Claims. The law mandates that anyone who wishes to sue a public entity must first file a Tort Claim before proceeding to the actual filing of a lawsuit in Superior Court. A TORT CLAIM IS ONLY USED WHEN FILING AGAINST A PUBLIC ENTITY. If there is a Tort Claim filed, it is filed with the public entity, not with an individual. No Tort Claim is necessary when suing an individual.
In addition, no one can sue a public entity without first filing a Tort Claim with the public entity that allegedly committed some personal injury (or "tort") against an individual. In fact, the explicit purpose of a Tort Claim is to inform the public entity that a lawsuit is forthcoming, so that the governing body may "accept or reject" the claim and resolve the matter at the lowest possible level. According to the PVUSD Board policies, the District has 45 days to either accept or reject a settlement of the allegations spelled out in the Tort Claim. When this 45 day period expires, or when the District rejects the Tort Claim, the individual(s) may file a lawsuit and proceed to Superior Court.
