When I attended a panel discussion on "Policy, Copyright, and Fair Use" at VidCon in Los Angeles on July 10, 2010, I was able to raise both the issue of false DMCA filing and the issue of greater human supervision over YouTube's Content ID copyright matching software with the two YouTube representatives on the panel, Victoria Grand and Glenn Brown, but I didn't always like the answers I got, as I explain in this video.

In addition to the clips I use from my own recording of the VidCon panel, I also use 3 images in this video.

One image I used comes from my own YouTube video player page from my video titled "YouTube Copyright and Fair Use Questions for VidCon on July 10" at http://www.youtube.com/watch?v=gZc_ITCbSvk

The image I used of the logos of various internet freedom advocacy organizations like the American Civil Liberties Union of Northern California and the Electronic Frontier Foundation comes from the document titled "Fair Use Principles for User Generated Video Content" at http://www.aclunc.org/issues/technology/blog/asset_upload_file939_6218.pdf

And, the final image I used comes from the Department of Justice's cybercrime reporting page at http://www.justice.gov/criminal/cybercrime/reporting.htm

  • Someone get up off their ass and make an uploading site that actually IS democratic and fair.

    So fucking tired of 100% of the internet being under private ownership.

    But you can't walk away from YouTube, because the legal jargon you witnessed in this video is exactly how they monopolized video uploading sites.

    I, for one, would rather have an orgish than not have one.

  • YouTube never cares about DMCA abuse/Fair Use. They just care about summoning the greedy corporations to make copyright claims on videos that are considered to YouTube that are infringing -- even if they're false claims. Instead, they only care about suspending its Users.

    a policy can be put in place if no warnings take place

    remove strike after a year, if there is warning, add 4 months to it

    so 1 year 4 months, so forth for each warning

  • if the video is 3 or more years old (mine made in late 05 -posted early 06 at most)

    those videos/music should have been grandfathered 2002-2006 in and sent a notice out saying all new videos would get copyright notices , why nail it, when the user hardly post anything too much power is bad for the company, even with me saying i do not own the song or/show

  • I think youtube has every right to worried about copyright. Youtube has simply been sued too many times. However I will say that some of youtube's punishments and policy's like copyright strikes are cruel and too harsh and don't fit the crime. I know of somebody who got a copyright strike in June of 2007 now it is November of 2011 and the strike is STILL ON HIS ACCOUNT WTF??? He got one DMCA complaint and he has to live with a 4+ year strike??? That's simply not fair or reasonable!!!

  • I have done some research, and Viacom may have broken the law by filing all those takedown notices. According to Universal City Studios v. Nintendo, companies who fraudulently claim copyright infringement can be held liable for damages.

  • Yeh I think if you talk to anyone on youtube or the internet for that matter theyre bound to support free speech especially true on the internet so make a DMCA abuse website dude :P!

  • The content ID system should categorize the content, stuff by news networks and informational networks that are most likely to to end up in a 'fair use' videos and quarantine them separate from the rest and have the stuff that is almost always used in 'fair use' go through a human being!
