@vampirerule117 I agree, Scalia also scared me with the idea that the government may be religious and that it may promote religions as long as it promotes a lot of religions. Then it also follows, historically, the government would only have to promote the many sects of Protestantism.

I am rather preferring Breyer at the moment. Scalia lost me the minute he started bringing up such controversial topics like abortion and gay marriage/should homosexual behavior be allowed during the living constitutional debate.
Because in the circumstances present in the 18 century, "People" in the famous phrase from the constitution "We the People..." refers only to white men. Does that mean allowing minorities and women are not protected under the constitution?!
