If this ignorant brute does not have the brains to realize that the wardrivers are not doing anything harmful to the people of the neighborhood, then he should not be entrusted with a badge.
It could be pointed out that all you were doing was listening for radio signals, not actually connecting to anything, but given his obvious lack of cognitive ability, he probably wouldn't get the distinction.

Plus, it's been argued that not securing a router, and or turning off security enabled by default is "effective consent" that term "effective consent" can be interpreted very broadly indeed. the law in my state is actually stricter, but I think it would be easier to defend against because it's just too broad

Your argument could be interpreted as,,,,,if you leave your front door unlocked, you have given me effective consent to enter your home. Texas law is well defined and there is no defense. It is unfortunately, a white collar crime which isn't taken seriously.

So you're saying it should be prosecuted much more aggressively? You're right, it could be argued that way, but it also could be argued(in my state) that using a drinking fountain that doesn't say "Free Water" is theft.

You know, maybe you stole someone's services to post videos about flamers. You weren't yelling any obscene names at that cop. I don't know, maybe the cop was slightly more intimidating than the flamer at USF.

Slightly?? go look at the video again, there is NOTHING intimidating about a fairy-prance!! I can even see what he's thinking: "Oh my God, if I don't get off the field, one of those football brutes will run over me, wait what was it again? right, no, left, no, right, oh the agony!!!"
