Update: He was sentenced to 41 days in jail and 2 years probation. However, since then, he has had several run ins with the law because of marijuana possession... which we all know shouldn't be a crime anyway... but yeh, at least he didn't get screwed over big time by the justice system.

Punishment shouldnt be based on revenge. He should get punished in some way, but if he is truly sorry and wont do it again...why give him the same punishment as someone who had no remorse and will gladly do it again? Probation or community service, yes. Full out years in prison, no.
