Police in Louisiana stop a truck and discover a firefighter is driving drunk at the wheel. The fireman refuses to do the sobriety test. A second officer finds a large stash of marijuana and smoking equipment.

  • I understand what you mean and yes it would. The problem with this video is we can't hear all the conversation because the narrator talks over it. I can only account for myself when I say the odor of an alcohlic beverage on a persons breath..their speech...their gait when they walk and their eyes all lend to probable cause. And, of course, their driving.

  • im just saying a portable breathilizer could make the job way easier. the probable cause is in the observation but seems a lil to loose for me evidence wise.

  • That's correct! Your statement said "they can't prove he's drunk and they arrest him for drunk driving?" The arrest is made on the Ofricers observations. It's not "proof" until the court determines the case is proven beyond a reasonable doubt. The officers observations in the field are the only "proof" he needs to make the arrest.

  • no the court sentences you for drunk driving from the evidence the police hand over to to prove you were drunk.

  • @praetorian2150 Police Oficers don't "prove" drunk driving in the field. That's what court is for dummy! "mandatory" breathalyzer"? People have the right to refuse. You'd make a great lawyer.
