Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered "fair," such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;

the nature of the copyrighted work;

amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

the effect of the use upon the potential market for or value of the copyrighted work.

"When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of "fair use" would clearly apply to the situation."

  • It wasnt an unfair question; look it: she was under the scrutiny of the judges, coming with an answer in 30 seconds, speaking fluent English to her best, and then end result : her nerves got the best of her. She as well as all contestants who get that far should be able to think on their feet regardless. I just didnt get the SIR part which to me was a bit outdated and out of place..

  • @massimoDSL I don't get the "SIR" part either. Filipinos have been programmed to bow down, kiss ass and be cowards. She sounded like a hotel or restaurant worker. That's the UTAK KATULONG of the Filipino. Using "sir" or "ma'am" in a conversation is like spraying perfume or cologne when you fart. You still smell the boiled egg odor. I have no idea why Filipinos love using "sir" or "ma'am." If you want to show respect, simply use Mr. or Miss, Mrs. followed by their last name.

  • @usofa1492 Yeah! What ever question she picked would have been too hard - some shit like that. Filipinos cannot accept losing and take out their frustrations here on You Tube. Why don't Filipinos be like the rest of the nations that didn't win?

  • would have been more lot easier kung nanagalog sya at may interpreter..shes brave and smart pero mas may chance sana....kakahiya ba kasing managalog...chance na nga yun bilang representative ng bansa ,,,,anyways i still congratulate her...

  • @reallyhatedisney Can you imagine Venezuelas, or any other country saying: "the question was too personal or too hard". Never!

  • I think that the question asked to Venus was the easiest to answer. Many pageants and job interviews use it to see what type of person the candidate really is. I think it is designed and developed as quick way to get to know the candidates. Saying the question was too personal is outrageous and ignorant to assume. Am I correct is saying that you also think Shamcey's question was too controversial as well? Every one on stage was nervous that night, not just Venus, that's pompous to even say.

  • @massimoDSL You are correct ! Addressing SIR/MADAM to someone who just introduced to you is not appropriate. It can only use as respect if you don't know the name of the person.

    And use Ms. and the surname if >>>> - the woman has a position of authority, - you don't know the woman's marital marital status. - the woman is your age or older than you.

  • LOL@jexxerfly you said it perfectly!

  • @massimoDSL venis pick it random right? and, it is always excuse for philippinos every year. if question too hard for venis, she should not enter contest. why blame everybody for your own ignorance because you and venis did not understand the question. blame no one except your own selves. you all say massive mistake??? the judge did not ask that at all, Philippinos make that up.

  • what is the biggest mistake NoyNoy has done? smile
