The continuing long term incarceration of Compean and Ramos by the US Attorney Johnny Sutton under the devious application of a criminal law not applicable to this case and under the deliberate manipulation of evidence to the jury is a blatant violation of the 8th Amendment which forbids cruel and unusual punishment. In the appeals hearing held today, the government admitted that its star witness,drug smuggler Osvaldo Aldrete Davila, lied on the witness stand. A wise move for the prosecution would be to drop the charges against the two border agents to avoid a new trial in which misconducts on the side of the prosecution are likely to be revealed. If a new trial is going to be held, the prosecution is going to lose because they do not have any reliable witness against the two agents at all.
Border agents Compean and Ramos were wilfully and wrongfully charged under the United States Code Title 18 Section 924(c)(1)(a)(iii), which was enacted to punish criminals using firearms to commit crimes of violence or drug trafficking crimes. The statute was not enacted to punish law enforcement officers who have made procedural errors or misjudgment in carrying out their duties. Their convictions must be overturned to preserve the integrity of the judicial system.
I would suspect some "family jewels" of this current administration? It is how the C.I.A. finances their mission: drugs. Is this why the nafta superhighway is needed (among other things).
