i agree this is a female juvenile sparrowhawk, a kestrel is orange and somewhat a lil smaller.

I think that is a Sharp shinned hawk.

I am sorry but that's not a Kestrel it is some type of accipiter. Maybe a coopers or sharp-shinned hawk if you are in the USA, or it could be a sparrow hawk if you are in Europe.

I'm in the UK, so it's probably a sparrow-hawk.
