Reportedly on April 20, 2011, the Kent County SPCA picked up a lost dog, "Neo", scanned his microchip and traced him to Canine Nation and a family in Wilmington. Instead of contacting his owners, per Delaware Law, KCSPCA kept Neo's inake a secret and euthanized him five days later on April 25.

According to the article, Kent County SPCA director claimed that Canine Nation had been called but later recanted that, saying Canine Nation was "supposedly contacted". AT&T phone records prove that no such contact was made.

The office of Governor Markell and the Delaware Department of Agriculture are investigating KCSPCA on several possible violations of Title 3, Chapter 80, the Delaware Animal Shelter Standards Law.

Kent County SPCA has the highest kill rate of any shelter in Delaware.
