It means the President has 60 days and then Congress can cut off funding. There is your check and balance. If you want someone to blame, blame Congress for being a bunch of spineless weenies.

Actually the War Powers Act gave Bush the right to do it. War does not need to be declared for military forces to be used. Not that it was the right decision, but it was legal.
