Ahh the guardsman is a highlander, he couldn't enter because it was hallow ground you see. There is nothing wrong with the AI.

I usually save before risky attempts because sometimes the AI bugs around and they can see you through walls at stealyth max 100. Is that the right way to play? Seriously I've been doing it so long it's hard to tell.

i made city-swimmer essential so this doesn't happen (with a spell) (she is a trainer of sneak...oh the IRON-Y), sometimes i save her life also, how you may ask?, companion share & recruit let's you give something to characters as a gift, so i gave her food...basically all the food inventory of the fair deal, that worked great, she never stole anything again (her ai makes her look for food, so why not give her what she wants?)
