Wisconsin State Patrol dash cam video shows Marinette's mayor having trouble standing, admitting to being drunk and joking around with deputies.

The newly released video is from Robert Harbick's OWI arrest Saturday afternoon.

In the video, the mayor is seen in the parking lot of the Marinette Taco John's, which is near the stoplight he allegedly crashed into.

According to the timestamp, around 4:20 p.m. a State Patrol deputy says to Harbick, "You've been drinking?" He responds, "Yeah." The deputy then says "A little bit too much maybe, huh?" Harbick replies, "Yeah" before falling back on his heels. Two State Patrol deputies then move closer to the mayor to help support him.

As one of the deputies prepares a breathalyzer, Harbick says, "Keep it out of the papers is all I'm asking. Can you do that?"

The State Patrol deputies then try three times to give the mayor a breathalyzer. They also ask him where he was drinking.

Harbick responds, "We had a cocktail at my place." The deputy says, "Just one cocktail?" The mayor replies," Just one martini." The deputy continues, "Must have been a big one."

After a fourth attempt to give the mayor a breathalyzer, Harbick is placed under arrest. The mayor is then told he is being taken to the sheriff's office to try their machine and if that doesn't work a blood test.

In the process of being cuffed, Harbick says to one of the deputies, "Can I hold your gun?" The deputy responds, "No, no you can't have that."

Following that, one of the deputies puts Harbick in the back of a State Patrol car.

The mayor was cited for OWI. Authorities say his blood alcohol level was more than three times the legal limit.

Earlier this week, he pleaded no contest and paid a nearly $900 fine.

As part of the plea, Harbick's driver's license will be suspended for nine months. He will also have to have a device installed in his car that prevents his vehicle from starting if the driver has alcohol on his or her breath.

Harbick has another court appearance next month for another citation connected to the crash.

The mayor has apologized and says he takes full responsibility. Harbick says he is also writing a letter to all the department heads of the city -- with another apology -- and reiterating that all employees should use better judgment than he did this past weekend.

Meanwhile, seven of the nine city council members have signed a letter asking for Harbick's resignation.

  • Its cuz he is old and jolly and these cops are on full surveilence. If he was black theyd set him free to avoid be judged as racist and to prove they like black people.

  • @TheGac504 You're an idiot. NO! That is not a breathalizer. It's a portable breath test. All it is designed for is to confirm alcohol is in the system. The Intox machine is a different strory. If you spit in that too many times, you get marked refused and will be revoked. However, many departments use blood as the primary. Beat that. You're an ignorant fool. 

  • @nbaker1229842005 No, the State Patrol has the odd PBT's and this guy was not giving a good breath and most of it was all spit. Other PBT's are not that sensitive. Besides, you don't need a PBT for reason to arrest. This guy admited to being drunk and he was clearly hammered.
