Simply, the man with the beard was assaulted, in a court of law the man that was doing the choking would be prosecuted without a doubt. Putting your hands on someone is always considered an aggressive act or an act of assault on ones person. Next time phone the police and they are obligated to go in and apprehend the man that was doing the choking.
