  • When one commits wilfull murder that person forfits his/her own life.

    This could involve serving the family of the one murdered for life, or the family could decide the fate of the murder up to and including execution. At least that was what I heard used to be the common law solution.

    And rape is somewhat similar. The victim would decide the fate of the perp.

    There is no reason for government to be involved, as the victim was the one violated, not the state.

    Outlaws leaving is good. As other towns become aware that this system drives outlaws away, they will likely adopt the system, progressively diminishing the places outlaws can go.

    To hire a court, a victim signs a contract promising to respect the court's decision including amount of restitution. If the victim isn't satisfied, too bad. They're bound by the contract. Some crimes are so bad that a court will decide restitution is not enough. The sentence then could be outlaw status.

  • I don't think jurors should be selected randomly. One of the problems with our current system is that the juries are composed of ignorant easily manipulated people with no knowledge of common law. If people want to serve as jurors, judges, arbitrators, etc., they should compete in a free market to provide justice most effectively and consistently. They should be chosen based on their record for providing justice and fair decisions.

  • I agree with the virtues of the common law system, but there are a few logistical problems I can perceive. First, until the common law system is universal, 'outlaws' may simply choose to leave rather than make restoration.  Furthermore, outlaws could band together, but I suppose that's where your militias come in. Property crime is relatively simple to redress, but how does one repay for murder or rape? What if the victims aren't satisfied with their reparations?What of the criminally insane?

    As far as rape and murder go, a small panel of six common people along with the advice of the D.A. or assistant D.A. should be able to choose what forum the defendant should face by the nature of the crime committed (common law, or the penal court). Let's say the guy whom committed the crime against the old lady has no job. He will just have to cough it up somehow ,work out a service agreement, or face the penal court as inability to pay. No system is perfect I'm afraid.

  • @dskap201 I think the kids could still chip in and help in other ways - fix things or clean the house, yard, garage ect whatever they are capable of and she needs and feels is fair. Rape and murder - I guess they get instantly outlawed and not allowed in.....just some thoughts on how maybe
