A prenuptial agreement is a document that spells out what your property rights will be -- and what your spouse's property rights will be -- in the event that you get a divorce. There are 3 things in which you need to remember about executing an agreement. The first being full disclosure about all your assets. If you fail to do so, your prenuptial agreement can be thrown out. Secondly, it needs to be fair on its face. That means each side needs to get the opportunity to review the document with their counsel. Lastly, there can be no duress when someone signs the document.
