Immigration attorney and AILA member Stephen Manning created this presentation to explain the multi-step process through which an individual can be arrested, detained, and deported under the government's Criminal Alien Program. It also identifies the legal weaknesses in the system as it is presently designed.

I am sorry, but you are wrong, I am only on the 22 second mark, but yes they are there for punishment, and the ones who have drugs get 3 months more than people who are looking to return to their families. My fiancee only tried to return to me 3 1/2 months, deportation after. There are people there that had backpacks of marijuana, they get SIX months. so Yes they are there for punishment. Excuse my hasty response, but just telling you how it is, as far as I have witnessed thus far.

I have tried "banging on courthouse door" tactic. I came really close to a false imprisonment suite / 1983 action, but would have to have done it pro bono. It is ultra vires! I hope this inspires some of my colleagues to truly advocate for their clients.

USCIS uses the word to punished recidivist meaning habitual criminals, in which overstaying a visa is a civil violation not criminal one. They are so mean heartless and evil.
