Had this man just stayed behind the enclosure around the bridge till I got my photos & video I wanted, he wouldn't of ended up here on my video.

The general rule in Australia about photographing in a public place seems to be that, unless there is a legal prohibition such as a statute or ordinance or a legally authorised sign indicating photography is not allowed, you can photograph virtually anything you wish. Members of the public, street performers etc. are deemed to be 'fair game' and can be photographed without their consent -- provided they are not in a place where there is a 'reasonable expectation of privacy.' It is also wise to be cautious of photographing anyone involved in an indecent act. Be mindful of what is proper and within the limits of decency.

Just think how many cameras you may appear on each time you head out of your house!!

  • No, I am NOT saying that, but Justice Dowd put it with ruthless clarity in R v Sotheren (2001) NSWSC 204: “ A person, in our society, does not have a right not to be photographed. ” I'm saying, if you don't want your photo taken move out of the way or as this bloke had a chance, stay behind the iron cladding. When I started taking photos & Video I couldn't see no-one in sight..
