YORK -- A 26-year-old York man has pleaded not guilty to selling drugs in the York College library.
Tony Witherspoon is accused of selling marijuana to a confidential informant on three different occasions -- one time in a basement bathroom at the educational institution.
The arrest affidavit says that on Sept. 19, 2006, Witherspoon allegedly told the information that he could get him "a full one" for $120. The affidavit says that the informant was first told to meet Witherspoon at the parking lot of Grand Central Foods. Later, Witherspoon allegedly changed the location, saying they should go to the library.
All three times, the marijuana was turned over to investigators after the sale took place and the transactions were done under surveillance by officers from the Nebraska State Patrol.
Witherspoon has been formally charged with two counts of delivery of a controlled substance, which is a Class III felony that carries a possible maximum sentence of 1-20 years in prison, if convicted. He was also charged with one count of distributing a controlled substance near a school, which is a Class II felony that carries a possible maximum sentence of 1-50 years in prison. If convicted, he could be facing as much as 90 years of incarceration.
He did not appear for his arraignment this past week, in York County District Court. His attorney, York County Public Defender Eric Williams, entered Witherspoon's plea on his behalf.
A trial has been set for Sept. 11.
