One of the main requirements of filing a California Trial by Written Declaration is that you MUST post your bail, which is the fine for the ticket, with the court in order to contest your traffic ticket.
Many of our clients have wondered why should I pay the court the fine for the ticket if I'm contesting my ticket. The reason is simple. Since with a Trial by Written Declaration you will not be going to court, if you lose your case the court doesn't want to have to chase you down to collect the fine for the ticket. As such, they require you to post the fine with the Trial by Written Declaration and if the ticket is dismissed, the court will refund you the bail in full.
