Dallas appellate lawyer Carl Cecere of Hankinson LLP tells KXAS NBC5 anchor Brian Curtis that the questions before the U.S. Supreme Court in 2012 will have important ramifications for years to come. "This is a virtually unprecedented Supreme Court term, in terms of its practical impact on people's individual lives, the chance to impact national elections including the presidency, and the sheer volume of important constitutional work they're doing," Cecere tells Curtis. According to Cecere, among the major questions facing the Court are the constitutionality of provisions of the Affordable Care Act (also known as Obamacare), whether states have the authority to enforce immigration laws, and whether Texas acted legally in establishing its legislative districts. "Over the past couple of decades, Supreme Court cases have tended to focus on individual rights: free speech, religion, discrimination, abortion, (and) gay rights. These cases are all different from that, and are similar to each other, in that they all focus on structural features of the Constitution involving federalism, that is, the relationship between the states and the federal government, and the distribution of powers between the two of them." Carl Cecere brings a depth of experience to his appellate practice forged through participation in high-stakes representations in a broad array of substantive areas. He has worked on appeals that involved important issues relating to bankruptcy, constitutional law, insurance, statutory whistle-blower protections, family law, oil and gas, complex business law, and habeas corpus.
