Ex-Wife Denies Hiring Hitman To Kill NYC Dentist

It was a dramatic day in a Queens courtroom, where the woman accused of hiring a hit man to gun down her husband in a playground and in front of their young daughter took the stand.

It was a surprise move in the trial of Dr. Mazoltuv Borukhova as she testified in her defense. On Wednesday, she was cross examined about a videotape. Prosecutors confronted the doctor with a tape she paid a cameraman to shoot ostensibly showing her 4-year-old daughter's unhappiness at being returned to the girl's father, Dr. Daniel Malakov.

The estranged husband and murder victim was just 34-year-old when a gunman shot and killed him execution style as he was returning his daughter to her mother.

Borukhova is charged with having Malakov, a Queens orthodontist, killed in a custody dispute.

The video the prosecution presented shows the two parents engaged in a tug-of-war over the child, a video taken six days before the man was killed.

"At this time you're not too crazy about your husband, are you?" asked prosecutor Brad Leventhal.

"I'm not too happy with his action, but not about him," replied Borukhova.

The doctor is on trial together with a 51-year-old relative, Mikhail Mallayev, for allegedly rubbing out the former husband. Mallayev was arrested after authorities lifted a fingerprint off a homemade silencer found at the scene.

On the stand, Borukhova denied having any involvement in the murder, the same thing she told CBS2 news two weeks after the shooting, before she was arrested.

Khaiko Malakov, the father of the murder victim, said his ex-daughter-in-law had a heart of ice.

"She's a high class liar, a liar, and [has an] ice heart," he said.

An aunt of the victim offered this: When he was killed, I said, 'The wife killed [him],' in a second, she did it!"

The prosecution is hoping to show that the motive was retribution for the father's winning custody and an effort by the mother to get the child back. They say Borukhova and Mallayev exchanged 65 phone calls in the six days prior to the killing.
