Thousands of seniors across the state rely on court-appointed guardians to make decisions, pay their bills and manage their health care. But some Washington families and even lawmakers said there are big problems with the state's guardian system.

Eleanor Barrick, 95, keeps receiving shut-off and cancellation notices from utilities and insurance companies. Her friends say it is because her guardian hasn't paid the bills.

The Stregue family said some of their relatives have been completely cut off from visiting their 88-year-old mother at a Puyallup nursing home after they complained about problems with her care.

"It's as if my mom is in a prison," Tim Stregue said. "In fact, I would argue a prisoner has more rights to pick up a phone and have a conversation."

In Barrick and Stregue's cases there were allegations of financial exploitation against people close to these women. Tim Stregue and Teresa Maxwell said they're not trying to take over their mother's finances, they just want to visit her.

Maxwell says she hasn't seen her mom since October.

"She grabbed my arm so tight and begged me to come and see her room," Maxwell said. "We were both crying."

After that visit, Maxwell said she and her family were banned from visiting her mom. She was told it was because they "agitated" her mother.

Tim Stregue said his mother wasn't allowed to attend her granddaughter Rachel's wedding. Last Saturday, he took the photos to the nursing home where she lives.

"They looked at the photos and made a phone call to an unidentified person and told me I was not permitted to allow my mom to see Rachel's wedding pictures," he said.

Sen. Jim Kastama looked into the guardian program after hearing complaints from constituents. He introduced legislation to try and address some of the problems and said his office was flooded with similar stories.

With the state mired in budget problems, Kastama says it's unlikely they'll get guardian reforms passed this session. Still, he promises to reintroduce the legislation next year.

"I think that as the public hears more about it, they'll come forward and put greater pressure on, and eventually it will be addressed," he said.
