In the early morning hours of November 2nd police raided Tulsa's Occupy Wall Street protest. According to Occupy Tulsa Organizers, the Tulsa police chief arranged a bargain with Occupy Tulsa earlier in the day where the volunteers would have a sit in arrest, they were to be carried off without the use of pepper spray.

In the video you can see that several protesters were pepper sprayed while sitting down on the ground, they were clearly not posing any sort of threat. They were sprayed directly in the eyes at close range. If there isn't a legal question here there certainly should be an ethical question. Is it right to use excessive force and torture just to prove you can do it? If the police chief were actually interested in discouraging arrests it would make more sense for him to let them know pepper spray would be used in the situation.

I decided to present the raw footage from the time police moved in throughout the entire arrest proceeding to eliminate accusations of deceptive edits. There is a small 5 second break in the middle of the video due to file size limits on my DSLR where I had to restart the video portion.

Update: Reports are that the pepper sprayed participants had interlocked arms which TPD interpreted as resisting arrest. However there are still ethical questions about the use of pepper spray directly to the eyes at close range. Is that measure of force justified?

  • I doubt the police people have a difficult time understanding the protesters. Laws about no occupying city parks at night is often necessary for safety reasons and so that people don't use the parks on just any night to camp.

    I think the protestors and police are both acting as one would hope.

    The only weapons should be words while possible. Antagonizing one another with any tauntings should backfire. The chant seems to have been meant well, but the delivery was harsh. Too loud.

  • @imagineers0 I think the reason the crowd was so harsh was because the pepper spray was completely unexpected and it was dark so it literally looked like they were coming up with bloody faces for a while. It seems incredibly cruel to spray people directly in the eyes, one of the protesters was blind for an hour afterwards. The sad thing about the introduction of "less lethal" weapons in the police force is that it becomes common to use those weapons in cases it's not really necessary.

  • If you Google "is using pepper spray unconstitutional" and click the first and second result you will see that a cop using pepper spray on any non-violent protester can be deemed unconstitutional. Even if those protesters violated a curfew, they were non-violent towards those cops, so the police had no right using pepper spray on them. I hope those protesters sue the hell out of the city of Tulsa in federal court and win.
