In January 2011 Governor Paterson unexpectedly signed a bill modifying the New York Bankruptcy Exemption Statute by greatly increasing the exemptions available and giving debtors filing bankruptcy a choice between using the Federal or New York exemptions. In this course, bankruptcy attorney Daniel Gershburg and trustee David Doyaga discuss the issues surrounding the newly available exemptions, the advantages and disadvantages between the New York and Federal exemptions, and how a debtor's attorney can best serve his clients' needs given these changes.
