  • @Borough81 It's a precedent. In other words, it helps serve as a guide to other judges who are deciding similar cases. It is not a law... & if you are interested in citing the case, know this: It ONLY applies to people who drove so perfectly, that nothing they did, aside from the practice of a legal u-turn, warranted them being pulled over. If this description holds true for you, I'll tell you the case. Chances are you are like the 99.99% who don't drive so well while drunk.

  • I can go to yahoo.com and type Settle vs State, Trezevant vs City of Tampa, and any other case and they come up fine. Were you driving or were you traveling? In the case of Trezevant vs City of Tampa he argued that he was traveling and was awarded $25000.00 for being stopped for 23 minutes. Settle had his DWI case thrown out because the State Trooper was in the grass not on the highway. However I cannot find any reference whatsoever on Merrigan vs State. All I'm asking for is a valid reference.

  • @SiRTim1000 I don't think you've read any of my other posts. This case only applies to people that drove PERFECTLY and therefore did not warrant being pulled over.
