What a dumbass!!! Stupid chick should watch where she was going. I can't believe the family was looking at a lawsuit. What happens when she's texting while driving? You don't get to sue the person who you ran into. Just listening to them talk for the few minutes was more that enough info for me to realize the whole family is dumb.

Fault no matter what. If she was not reading her friend's text for a moment, she could have been reading the time on her watch or looking away, greeting someone. It is the city's job to NEVER leave dangers like this without markers. A small child who is less aware could have been killed. They could have stationed one man there & had the other fetch markers & cones. City's fault hands down.

first...dep should put a warning like a cone or something to warn people that there is a hazard ahead. second, that girl should not have been texting while walking and instead should call or wait because texting takes your eyes off the road. What is it with teenagers with texting these days? Overall, the girl deserves what happened to her because she wasnt looking where she is going, and the dep hould put up warning signs or something.
